iWantClips℠ Twitter contest official rules (“Official Rules”). No purchase necessary. A purchase does not increase your chance of winning. There is no fee to enter this contest. Void where prohibited by law. Open only to legal residents of the 50 United States and the District of Columbia who are 18-years old or older and located in the United States at the time of entry.

  1. Eligibility. This contest is open only to legal US residents of the 50 United States and the District of Columbia who are 18-years old or older at the time of entry. Void outside the US, in Puerto Rico, and wherever prohibited by law. Employees, contractors, directors, and officers of Gatsby Enterprises, Inc. (“Sponsor”), its parent, subsidiary, and affiliated companies, and the immediate family members of each (partner, spouse, parent, child, sibling, grandparent, and spouse or “step” of each) and those living in the same households of each (those persons whether related or not who live in the same residence for at least three months during the 12-month period preceding the start date of the contest), are not eligible to participate.

  2. July 15 - July 18 2022. The contest will run during the dates and times listed in the tweet promoting the contest (“Contest Period”).

  3. To Enter.

    1. To enter the contest, during the Contest Period go to www.twitter.com, and (a) if you already have a Twitter account, log on using your Twitter user name and password, and then become a follower of @iWantClips by searching for “@iWantClips” and clicking on the @iWantClips icon and then clicking the “Follow” button; or (b) if you do not already have a Twitter account, create a free Twitter account according to the instructions on Twitter and follow @iWantClips by following the procedures as indicated in (a) above. Please note that you must agree to comply with the Twitter Terms of Use and Privacy Policy to create a Twitter account.

    2. Then, during the Contest Period, @iWantClips will tweet a photograph or a link to a photograph (“Photo”). Photo will also be available at iWantClips.com/CaptionContest (“Website”). To enter, you will be required to tweet a statement that includes: (a) a caption for Photo (“Statement”); (2) the hashtag “#iWantCaption;” and (3) the @reply “@iWantClips” (collectively, “Entry”). Failing to include “#iWantCaption” and “@iWantClips” with your Statement might result in your Entry being disqualified.

    3. All Entries become Sponsor’s property and will not be acknowledged or returned. If any Statement contains material that is violent, obscene, illegal, inappropriate, or racially or morally offensive or if any Statement does not comply with these Official Rules or meet Sponsor’s standards for any reason, as determined by Sponsor in its sole discretion, that Statement (and the related Entries) might be rejected as ineligible for consideration or deleted from the @iWantClips Twitter page. Entries must comply with all laws, rules, and regulations. Sponsor is not obligated to copy, publish, display, or otherwise exploit the Statement.

    4. Entries must be received before midnight on the last day of the Contest Period to be eligible for the contest. Sponsor’s computer will be the official timekeeper for all maters related to the contest. Limit one Entry per person during the Contest Period. Multiple Entries received from any person or Twitter account beyond this limit will void all those additional Entries. Entries/Statements that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted. In case of a dispute over the identity of an entrant, the authorized account holder of the Twitter account used to enter will be deemed to be the entrant. “Authorized account holder” means the person who is assigned to a Twitter account by Twitter. Entry constitutes permission (except where prohibited by law) to use entrant’s name, Twitter username, city, state, likeness, image, and voice for advertising, promotion, and publicity purposes in all media now or afterwards known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

  4. Winner Selection. Employees of Sponsor will judge the contest and select one potential winner (“Winner”) based on the following judging criteria: Originality (50%) and Creativity (50%). In the event of a tie, the judges will break the tie by selecting the tied entrant who received the highest points from the judges for Originality as the potential Winner. If a tie remains, the tied Entrants will be judged by an additional tie-breaking judge, using the judging criteria, to determine which of the tied entrants will be the potential Winner. All decisions of the Sponsor and judges are final and binding for all matters related to the contest. Winning is subject to verification of eligibility. The Sponsor reserves the right to pick fewer than one potential Winner or to extend the Contest Period if in its sole discretion, Sponsor does not receive a sufficient number of eligible and qualified Entries. Potential Winner will be notified by direct message on Twitter to the account used to submit the Entry. Potential Winner may be required to sign and return an affidavit of eligibility, release of liability, and, except where prohibited, publicity release within seven days of that notification. Noncompliance within this period with these Official Rules or the return of or inability to deliver any prize/prize notification may result in disqualification and, at Sponsor’s discretion, and time permitting, an alternate potential Winner may be selected from among all eligible remaining Entries based on the judging criteria.

  5. Prize. There will be one prize awarded to Winner (“Prize”), consisting of US$100. All taxes and other expenses, costs, or fees associated with the acceptance of Prize are Winner’s sole responsibility. If Prize is unclaimed within a reasonable time after notification from Sponsor, as determined by Sponsor in its sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible Entries at Sponsor’s sole discretion.

  6. Conditions. By entering the contest, each entrant agrees for entrant and for entrant’s heirs, executors, and administrators (a) to release Sponsor, Twitter, and their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that might occur, directly or indirectly, whether caused by negligence or not, from that entrant’s participation in the contest or their acceptance of the Prize; (b) to indemnify Released Parties against any liability resulting or arising from the contest and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize; (c) if selected as a Winner, to the posting of that entrant’s Twitter username on Website and the use by Released Parties of that name, voice, image, or likeness for publicity, promotional, and advertising purposes in all media now or afterwards known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, on request, to the giving of consent, in writing, to that use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error in it or in the contest itself, and to be bound by all decisions of the Sponsor, which are binding and final. Failure to comply with these conditions may result in disqualification from the contest at Sponsor’s sole discretion.

  7. Additional Terms. Sponsor reserves the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the contest or the operation of it is unlawful and subject to legal action by Sponsor, who may seek damages to the fullest extent permitted by law. Sponsor’s failure to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsor (excepting compliance with codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to entrants’ or to any other person’s computer relating to or resulting from entering or downloading materials or software for the contest. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of Entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. Sponsor reserves the right to cancel, modify, or suspend the contest or any element of it (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, Sponsor reserves the right to select a Winner in a random drawing from among all eligible, non-suspect Entries received before the time of the event warranting that cancellation, modification, or suspension. Notice of that cancellation, modification, or suspension will be posted at Website. Sponsor may prohibit any entrant or potential entrant from participating in the contest, if that entrant or potential entrant shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other entrant, Sponsor, or Sponsor’s agents or representatives; or behaves in any other disruptive manner (as determined by Sponsor in its sole discretion).

  8. Not Endorsed by Twitter. By participating in this contest, you acknowledge that this contest is in no way sponsored, endorsed, or administered by, or associated with, Twitter and hereby release Twitter from any liability arising from or related to this contest. The information you are providing for this contest is being provided to Sponsor and not to Twitter, and will be used to notify you if you have won, and to inform you about special offers from Sponsor.

  9. Disputes. California law governs all adversarial proceedings arising out of these rules or the contest. As the exclusive means of initiating adversarial proceedings to resolve any dispute arising out of these rules or the contest, a party may demand that the dispute be resolved by arbitration administered by JAMS ADR in accordance with its consumer arbitration rules, and each party hereby consents to any such dispute being so resolved. Judgment on any award rendered in any such arbitration may be entered in any court having jurisdiction. Any arbitration initiated must be conducted by one arbitrator in Los Angeles, California. The arbitrator must not award punitive damages in excess of compensatory damages. Each party hereby waives any right to recover any such damages in any arbitration.
